Super hero dads have charges brought by the county.
Donald Tenn and Paul Fisher (Spiderman and Superman) will appear before a jury on April 13th, 2009, in Columbus, Ohio. Despite no physical damages, and no intent to cause harm to the structure in question, (the prerequisites for vandalism), the pair have been indicted for felony level vandalism. If found guilty the duo could spend up to eighteen months in prison.
SUPERHERO DUO STUN BUCKEYE FANS WITH DARING CRANE DEMONSTRATION
Columbus, Ohio – September 27, 2008 --- As 100,000 Ohio State football fans began arriving for their pre-game festivities early Saturday morning they were astounded to witness superheros Batman and Spiderman perched atop a 125' construction crane on Lane Avenue, a couple hundred yards from Ohio Stadium.
As part of an international effort to bring attention to the routine systematic and gender-biased removal of fathers from the lives of their children, two superhero dads, dressed in costumes as Spiderman and Superman, climbed to the top of a 125' crane to hang a banner stating, "STOP THE WAR ON FATHERHOOD".
When asked to comment, John Fowler, National Coordinator for F4J said, ”These fathers have waited years for change. Their pleas have fallen of deaf ears when all they are asking for is to be able to love a raise their children. Why should children be denied the right to have two loving parents?”
When confronted about the controversial nature of the demonstration Mr. Fowler replied “What would you be willing to do if a corrupt court denied you access to your children?”
At the time this press release the identities of the demonstrators were not known and it was not clear how long the Superheros would remain on the crane.
Superhero Dads Make Demands From Ohio Crane
Columbus, Ohio – September 28, 2008 -- Superhero dads camped on the crane in Columbus make demands to Governor Strickland and Governor Schwarzenegger.
Still camped a top a crane near Ohio State University, Fathers-4-Justice members Paul Fischer, of Ohio and Donald Tenn, of California released their demands. The dad's, dressed as super heroes released their demands to Ohio's Governor Strickland and California's Governor Schwarzenegger.
The fathers say, they will come down when the Governors from both states agree to a non partisan investigation into the family court system in their respective states. They insist that the investigation answers the questions; why is there gender bias in the family court system and why is there no perjury for false allegations?
"These fathers want and deserve answers," says, Fathers-4-Justice, national board member, Brian Holladay, "They are up there making a statement for everyone who has suffered at the hands of the family courts. Nobody recognizes that fathers can't see their childern. Ridiculous visitation schedules, un-inforced court orders and parential allienation along with false allegations create the problem. We need to stop this now."

Fisher and Tenn want answers, but they know the problems within the family courts extends throughout the United States.
The news of the situation in Columbus has spread across the US and Canada like wild fire. Web sites and blogs are flooded with pictures from the scene and comments of support for the fathers.
Chris Smith, US Media coordinator for F4J said, "My phone is ringing off the hook and my e-mail is swamped with agencies who want the most up-to-dated information from the scene.
Superman Claims Family Court Lacks Due Process
"The family court system needs to be investigated, " says Paul Fisher, the Fathers 4 Justice Daddy Activist who recently spent three days 125 feet above ground on a crane in Ohio. Fisher was drawing attention to what he claims is family court corruption. "The mainstream media is ignoring this serious issue affecting a lot of people. We decided to take it to the next level," he said, speaking of fellow crane sitter Superhero Activist Donald Tenn from California.
"I made the sign saying STOP THE WAR ON FATHERHOOD," stated Fisher, "I believe there is a war in this country against fathers. In my case the judge was biased."
"I took my case all the way to the Ohio Supreme Court, and won. Then the family court judge made changes and decisions without a hearing," says Fisher, "after five years of day on, day off, equal shared parenting, she reduced my time with my daughter.
Fisher says he never expected to find gender bias in family court, "I'm of the generation that grew up believing in equality. I was raised by a single mom. She taught me the genders are equal." Fisher had been sharing his daughter's care since she was an infant.
When reminded that feminist groups claim women are discriminated against in family court, Fisher suggested, "Fathers claim gender bias. Mothers claim gender bias. Let's do an investigation and learn the truth."
He recalls having a lot of time to think about things during those hours in the air. He said even though men are victims most often, it can happen to any parent. He clarified, "What drove me to go up on a crane was the obligation as an American to defend the Constitution. The Constitution guarantees us due process."
Superhero Dads Stand Their Ground
Columbus, Ohio – September 29, 2008 -- Superhero dads still on crane as they await response from Governor Strikland and Governor Schwarzenegger.
Fathers-4-Justice Members Paul Fisher, 34 of Ohio and Donald Tenn, 52 of California have secured themselves 125' in the air on top of a crane on Lane Avenue in Columbus, Ohio under one condition; they're waiting until Governors Ted Strickland and Arnold Schwarzenegger begin investigations in the family court systems in Ohio and California. Starting their third day more than 125 feet above ground, the Fathers-4-Justice members say they don't mind a little sacrifice for civil and family rights.
Crane workers reported to the job site this morning and were unable to work while Tenn and Fisher remain positioned on the equipment. Fisher said, “They understand why we are doing this.”
Donald Tenn has legal rights to see his daughter, yet has not been able to see her in 2 years.
Paul Fisher has won his case in Supreme Court and the decision was then violated in the local family court.
The Ohio Supreme Court Fisher Case
Paul's victorious Fisher Case of the Ohio Supreme Court determined that termination of co-custody requires the same standards as terminating sole custody. While winning the case helped Ohio, it did not help Paul and his daughter Demetra. After overturning the judges decision, she simple took away more visitation on the remand as punishment.
On his website Paul writes, "Judge Zitter has issued a new judgment on this case, without holding a new hearing. Mother is awarded full custody, father has visitation for 48 hours every other weekend."
In all her wisdom, Judge Zitter has upheld her previous findings and appended a "change of circumstance" section to comply with the mandate of the Ohio Supreme Court. She also removed incriminating statements against the mother and added new opinons detrimental to the father. Her chosen change of circumstance is that the father "apparently changed his intentions".
"Judge Zitter has determined that is in my daughter's best interest to only have time with me 27 hours a week, on average. Interestingly, she reached this conclusion without a new hearing, using the exact same evidence as her previous determination that 50% parenting time with both parents was in my child's best interest."
One Father Comes Down
Columbus, Ohio – September 29, 2008 -- Police warned the men of the dangerous weather approaching Columbus so Fathers-4-Justice National Coordinator John Fowler, negotiated with Paul Fisher to climb down from the 125' crane.
"The men are out of food and water", Fowler said. "I have tried to impress upon them that the situation has become dangerous. Paul came down, but Donald is hunkered down for the night. Don insists that he is waiting for a response from California Governor Arnold Schwarzenegger's office, then He will come down."
The California Governor's office was contacted today and nothing was accomplished.
Day 4 - Spiderman Still Atop Crane
OSU Campus Police refuse to allow food or water to be raised for Donald Tenn aid
Columbus, OH - September 30, 2008 -- "Arnold Schwarzenegger used to be a hero of mine," says John Fowler, National Coordinator for F4J USA, "now Donald Tenn and Paul Fisher are my heroes. Schwarzenegger is the villain. He needs to stop cowering to the radical feminists California and address the issue. By not doing so, he is ignoring the rights of California’s children to have a loving relationship with both parents. Why is it so difficult for an elected representative to make a simple statement stating our family law system may be broken, and we must find out how to fix it? This is the largest social justice issue of our time," says Fowler. "Governor Strickland likes to play Keno, well, he needs to stop gambling with the lives of our children and both Governors’ must address this issue. The gloves are off"
Now spending his fourth morning on the crane, Donald Tenn, aka Spiderman, has not yet negotiated his descent. Spiderman is under a tarp to ride out the nasty weather, and the deafening silence of Governor Schwarzenegger.
Hungry, thirsty and exhausted, Spiderman Donald Tenn, remains determined knowing the suffering of not seeing his daughter is far worse than any physical pain or discomfort he might experience atop his 125' perch at Ohio State University.
Fathers-4-Justice members and supporters from all over the county are calling F4J board members for updates. Brian Holladay, a F4J board member says, “This extends way beyond just our members.”
Paul Fisher, aka Superman, agreed to come down under the exclusive watch of NBC news, who broke the story yesterday, and a safety crew from the construction site and campus security. He was taken into police custody and charged with vandalism and will appear in court this morning.
Donald Tenn - Alone atop the crane
As Donald Tenn started his fourth day this morning on a wet construction crane in Columbus, Ohio, he said through a walkie-talkie, "I have nothing to lose".
Earlier he told me, "I've followed the law, been bounced back and forth between states, and been falsely accused of domestic violence. I finally won visitation in Illinois. The judge even reprimanded her mother. I had one visit. That's it. She's able to use services funded by the Violence Against Women Act to illegally keep me from my daughter."
Until Madison's mother illegally abducted her to Illinois, Tenn was her stay-at-home parent. It's Madison he worries about, not himself. He says she's being hurt by the family court system and he has to protect her. A board member of Fathers-4-Justice, he says he won't come down until Governor Schwarzenegger agrees to a nonpartisan investigation into the family court system. Calls to the Governor's office have yet to be returned.
Tenn's Sacramento phone rings off the hook at all hours of the day. Friends say he always makes time to listen to parents trying to avoid or recover from the devastation of losing contact with their children. When he isn't grieving for his own little girl Madison, he says, his heart aches for the thousands of other parents he knows who are experiencing the same thing.
Tenn has been sending Madison packages in the mail about 3 times a week. "I've probably sent over 300 packages so far," he told me recently, "they include books, healthy snacks, small toys and stickers. She loves stickers"
When asked if he wants to keep Madison away from her mother when this is resolved, he says, "No. I've always wanted equal custody, equal parenting and equal responsibility, for each of us." Asked if his case was unique he replied, "I've traveled the country talking to other parents. And what I hear all the time, from mothers and fathers, is that they want equal parental rights, equal physical and legal custody."
Spiderman Descends Crane
Columbus, Ohio –September 30, 2008 -- After an incredible 80 hours atop a 125' crane at Ohio State University, Spiderman and everyday superhero, Donald Tenn, is coming down safe and sound to fight another day.
"Swat was on their way up if he didn't come down. We now know that Paul Fisher is being released and are sending a support team to him," says John Fowler, National Coordinator for F4J US, "We're very happy to see this action come to a very successful and peaceful conclusion." Tenn was able to conduct a crane top media interview with NBC Channel 4 and a large radio station in his home town of Sacramento.
Troops were beginning to rally at the base of the crane in support of their superhero. "We're not leaving without Paul and Don," one activist was quoted as saying from the scene.
"Both of these men are now admired and revered worldwide for their self-sacrifice for a cause that is greater than anyone of us, and sadly affects us all", says Kris Titus, National Coordinator for Fathers-4-Justice Canada. "There are things we are very proud to share with the U.S., unfortunately parental inequality that harms children is one that no one should be proud of."

Paul expains, "Don has a $5,000 bond we need to raise $575 to get him out. He is being transferred to the "Work farm" (FCCC 2) tonight. The inmates tell me that is a rough place, all that I talked to confirmed this. The guy in my cell who was being held on murder charges, and facing 46 years in prison, told me I did not want to be sent to the "Farm." I was detained in a maximum security cell with 5 other inmates. I was released on my own recognizance. Meaning, I didn't have to post bond."

Paul Fisher, aka Superman, will be in Columbus Municipal Court this Tuesday.
Attorney, Ms. Melanie Mills, Esq., will represent Paul Fisher in Columbus Municipal Court tomorrow. Fisher faces vandalism charges, after recently spending three days atop a crane on the campus of Ohio State University .
Paul, dressed as superman, hung a banner off of the crane, stating,”Stop the War on Fatherhood.” Paul is a member of Fathers-4-Justice, a civil rights group campaigning for truth, justice and equality in family law.
Donald Tenn, also a member of Fathers-4-Justice, of California climbed the crane with Fisher. Tenn ,was also represented by Ms. Mills, in Columbus Municipal Court last week on charges of felony vandalism. Those charges were dismissed.
When asked to comment, Donald replied that, "Melanie is doing a fantastic job and I cannot say enough good things about her."
Melanie has been representing fathers in domestic court for the past 16 years and has first hand experience in the issues facing parents caught in custody battles.

Donald Tenn's Crane Demonstration Charges Dismissed!
October 10 2008 Columbus, Ohio
Donald Tenn (aka Spiderman) appeared in Columbus Municipal Court this morning at 9:30 AM. The results were that Felony Vandalism charges were dismissed.
Donald was represented pro bono by Ms. Melanie Mills, Esq. also know as Wonder Woman. Melanie will also be representing Paul Fisher ,aka Superman, in his hearing this Tuesday. When asked to comments Donald replied that "Melanie is doing a fantastic job and I cannot say enough good things about her"
Melanie has been representing fathers in domestic court for the past 16 years and has first hand experience in the issues they are dealing with.
